During this session, we will define and discuss informed consent and the questionably competent patient; distinguish the differences between the voluntary transfers of decision making authority (Powers of Attorney) and involuntary transfers (Guardianship) and the limitations on decision making authority for substitute decision makers, agents and guardians.


9:00 am - 12:00 pm     The Importance of Healthcare Anti-Discrimination Protection in Current Clinical Practice

Overview:  During this presentation we will explore how both structural and interpersonal discrimination in the healthcare setting affects specific patient populations, including patients with mental health and substance use/abuse histories and patients with preexisiting conditions.   We will also discuss the strengths and shortcomings of our legal and ethical frameworks in addressing this discrimination; and examine ways in which bioethics and clinicians can play a role in reducing the harmful impacts of discrimination on patients.

Overview:   During this presentation we will discuss medical error, negative outcomes, and best approaches to disclosing medical error to patients/families and explore various approaches to avoiding medical malpractice litigation.  We will also explore the pros, cons, and how to utilize alternative dispute resolution such as mediation and arbitration; and discuss the enforceability of pre and post-dispute arbitration agreements.

Overview:  During this session we will discuss how mediation training can prepare healthcare professionals to manage conflict effectively and explore the difference between mediation and other forms of conflict resolution.  We will iscuss the steps in the mediation process; and identify and utilize those skills to help function as a ‘neutral’ at meetings to facilitate discussion and attempt to achieve resolution.
